This document is currently in draft form. It reflects our intended customer terms but is undergoing legal counsel review before becoming the formal binding agreement. For now, it represents our current operating practice in good faith.

Overview

This document describes the terms under which a customer ("Customer," "you") books a food truck through the FleetEatsNow marketplace operated by Fleet Eats Now LLC ("FleetEatsNow," "we," "us," "our"). By placing a booking on fleeteatsnow.com, you agree to these terms.

The short version

FleetEatsNow is a marketplace that connects you with independent food trucks. You book through us, you pay through us. The truck shows up and serves the food. We handle the logistics; the truck is the actual food service provider.

1. What FleetEatsNow Is

1.1 We are a booking marketplace. FleetEatsNow operates a two-sided online marketplace that connects customers (event hosts, businesses, individuals) with independent food truck operators in Tampa Bay. We facilitate the discovery, booking, and payment process.

1.2 We are not the food service provider. The food truck you book is an independent business. They prepare and serve the food, set their own menu, operate their own kitchen, and hold their own permits and insurance. FleetEatsNow does not prepare food, employ truck staff, or operate the trucks listed on our platform.

1.3 Marketplace facilitator. We act as a marketplace facilitator under Florida law. We collect payment, remit applicable sales tax where required, and pay the truck their share after the event.

2. How Booking Works

2.1 Browsing and selecting. You can browse available trucks on fleeteatsnow.com, view their pricing, cuisine, capacity, and service area. You may select one truck or combine multiple trucks for a single event.

2.2 Pricing you see. For each truck, you see an estimated total based on your guest count, event duration, and date. The estimate includes the truck's quoted price, a 15% service fee paid to FleetEatsNow, any applicable surcharges (weekend, holiday, travel beyond service area), and any applicable sales tax. The total you see at checkout is the total you pay.

2.3 Payment authorization. You provide payment information through our payment processor (Stripe). Your card is charged in full at the moment you confirm your booking. We do not store your card details — they are tokenized through Stripe.

2.4 Confirmation timeline. After payment, your booking request is sent to the truck for acceptance. The truck has up to 2 hours to accept or decline. Once the truck accepts, you receive a confirmation email and your event is locked in. If the truck declines, you receive a full refund automatically.

2.5 Multi-truck bookings. You may book multiple trucks for one event in a single checkout. Each truck independently accepts or declines its portion. If one truck declines, you may keep the others or cancel the whole group.

3. Pricing and Payment

3.1 You pay upfront in full. Unlike many catering services, FleetEatsNow charges your full booking amount at checkout — not a deposit. This protects both you and the truck. The funds are held by FleetEatsNow until the event takes place; you are not paying the truck directly at booking time.

3.2 Service fee. The 15% service fee is paid by you and goes to FleetEatsNow. The truck operator receives 100% of their quoted price. The service fee is non-refundable in cases where you cancel within the no-refund window (see Section 4).

3.3 Pricing example. If a truck quotes $3,000 for your event: truck's quoted price $3,000 + service fee (15%) $450 = total you pay at checkout $3,450.

3.4 Sales tax. Florida sales tax on prepared food is collected and remitted by FleetEatsNow as the marketplace facilitator. The tax amount, if applicable, is shown separately at checkout.

4. Cancellation Policy

4.1 Free 24-hour window (all tiers). You may cancel within 24 hours of placing your booking for a full refund, regardless of how close the event is. This protects you against booking mistakes and applies regardless of which truck tier you booked.

4.2 Per-truck cancellation tiers. Each food truck on Fleet Eats Now selects one of three cancellation tiers, which governs refund cutoffs for that truck's portion of your booking. The applicable tier is shown on the truck's profile page and again on the checkout page. You acknowledge the per-truck terms before completing payment.

For multi-truck bookings, each truck's tier applies independently to its portion of the booking. You may receive a 100% refund from one truck and a 50% refund from another in the same cancellation. The cancel page shows the per-truck breakdown before you confirm.

4.3 24-hour day-of floor (all tiers). Regardless of which tier the truck has selected, cancellations within 24 hours of the event start time are non-refundable. Food prep is underway, ingredients are purchased, and the truck cannot recoup the lost slot.

4.4 Truck policy changes. Trucks may update their cancellation tier from time to time (subject to a 30-day cooldown between changes). When a truck changes its tier, the new tier applies to NEW bookings only. Existing bookings keep the tier that was in effect at the time you booked, captured as a snapshot on your booking record.

4.5 Truck-initiated cancellations. If the truck cancels your booking after accepting it — for any reason, including no-show — you receive a 100% refund within 5–10 business days regardless of tier. You are also entitled to compensation if the no-show results in additional costs to you (see Section 8.2).

4.6 Force majeure. If weather, emergencies, or other circumstances beyond either party's control prevent the event, we work with both you and the truck to reschedule or refund on a case-by-case basis. Contact us as soon as you know.

4.7 How to cancel. Cancel by clicking the cancel link in your booking confirmation email or by emailing booking@fleeteatsnow.com. Refunds are processed automatically (one per booking row, summed into a single Stripe refund) and arrive in 5–10 business days depending on your card issuer. The cancel page shows the per-truck refund breakdown before you confirm.

5. What You Can Expect from the Truck

The truck operator is responsible for:

  • Arriving on time, fully staffed, and ready to serve
  • Serving the menu they listed (substitutions must be communicated in advance)
  • Holding all required permits and insurance
  • Complying with all applicable food safety regulations
  • Treating you and your guests professionally
  • Bringing all necessary equipment, ingredients, and supplies

FleetEatsNow vets trucks before approval but does not directly supervise their operations on event day.

6. What We Ask of You

6.1 Accurate event information. When booking, you must provide accurate event date, start time, duration, guest count, address, location type (private property, commercial, outdoor venue, etc.), and any special requirements (electrical hookup availability, water access, etc.). If the event details on the day differ materially from what you booked, the truck may charge additional fees, decline service, or leave without refund.

6.2 Location accessibility. You are responsible for ensuring the truck can park legally and safely at the event location, the location has the space the truck requires (verify the truck's space requirements before booking), and any necessary permits for the venue have been obtained by you or the venue owner.

6.3 Authorized payment. By providing payment information, you confirm that you are authorized to use the payment method and that the funds are sufficient. Disputed charges or chargebacks may result in additional fees or removal from the platform.

6.4 Adult behavior. You and your guests must treat truck staff with respect. Harassment, threats, or other inappropriate conduct toward truck personnel may result in the truck leaving without refund and your account being suspended.

7. Dietary Restrictions, Allergies, and Food Safety

7.1 Communicate allergies in advance. If you or any of your guests have food allergies, dietary restrictions, or other food sensitivities, you must communicate them directly with the truck operator in advance through the booking notes or via direct contact after confirmation. FleetEatsNow does not relay or verify allergy information beyond passing on your booking notes to the truck.

7.2 Cross-contamination risk. Food trucks operate in shared kitchen spaces and cannot guarantee that any item is free from cross-contamination with allergens (including but not limited to peanuts, tree nuts, dairy, gluten, soy, shellfish). If a guest has a severe allergy, you should confirm directly with the truck before the event.

7.3 Food safety. The truck operator is solely responsible for the safety and quality of the food served. FleetEatsNow does not prepare food, supervise food preparation, or guarantee food safety. The truck holds all applicable permits and insurance for food service.

7.4 If you believe you have a food safety concern. If you or a guest experiences a food safety issue (illness, allergic reaction, etc.) after an event, contact us at booking@fleeteatsnow.com as soon as possible. We will document the report and put you in direct contact with the truck operator. Resolution is between you and the truck operator; FleetEatsNow may facilitate communication but is not a party to any resulting claims.

8. Disputes and Refunds

8.1 Service issues. If the truck arrives but you believe the service was materially below what was advertised (e.g., insufficient food, significantly delayed arrival, failure to serve the agreed menu), contact us at booking@fleeteatsnow.com within 48 hours of the event with details. We review on a case-by-case basis and may issue partial or full refunds at our discretion, with the truck's share adjusted accordingly.

8.2 No-show by the truck. If the truck fails to show up at the event, you receive a 100% refund. Additionally, you may report any reasonable, documented incremental costs you incurred (e.g., emergency replacement catering); we may compensate at our discretion or facilitate a claim against the truck.

8.3 Chargebacks. If you believe you have a billing dispute, please contact us first at booking@fleeteatsnow.com before initiating a chargeback with your card issuer. We aim to resolve issues directly. Chargebacks initiated without prior contact may result in account suspension while the dispute is reviewed.

9. SMS Communications

9.1 SMS is opt-in and optional. Providing your phone number at booking does NOT enroll you in SMS. To receive any text messages from FleetEatsNow, you must explicitly tick the "Send me SMS updates" checkbox at the booking contact step. The checkbox is not pre-checked, and you may complete your booking without it.

9.2 Messages sent (transactional only). Customers who opt in receive SMS for: booking received confirmation, truck-accepted confirmation, day-before event reminders, and refund updates. We do not send marketing or promotional SMS.

9.3 Opting out. Reply STOP to any FleetEatsNow SMS to opt out immediately. Reply HELP for support, or email booking@fleeteatsnow.com. Opting out does not affect your booking — email notifications continue.

10. Privacy and Data Handling

Our full privacy policy is at fleeteatsnow.com/privacy. Key points for booking customers:

10.1 Information we collect. When you place a booking, we collect: your name, email address, phone number, event address, event details, and payment information. Payment information is tokenized through Stripe; we do not store your card details.

10.2 How we use your information. We use your information solely to process your booking, communicate with you about it, pass relevant details (event address, contact info, dietary notes) to the truck so they can serve you, comply with legal obligations (tax, fraud prevention), and improve the platform.

10.3 Information we do not sell. We do not sell or rent your personal information to third parties for marketing. We do not share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

10.4 Deletion requests. You may request deletion of your data by emailing booking@fleeteatsnow.com. We comply within 30 days, subject to legal retention requirements (tax records, payment records, etc.).

11. Limitation of Liability

11.1 FleetEatsNow's role. FleetEatsNow is a booking and payment facilitator. We do not prepare food, employ truck staff, or operate vehicles. Our liability is limited to providing the platform and processing payments.

11.2 Maximum liability. To the maximum extent permitted by law, FleetEatsNow's total liability to you arising from your use of the platform, any single booking, or any claim is limited to the total amount you paid to FleetEatsNow for that specific booking (including the service fee). FleetEatsNow is not liable for consequential, incidental, or indirect damages, including lost profits, lost business opportunity, or damages arising from food safety incidents, vehicle damage, or property damage at the event.

11.3 Exclusions. The limitation in Section 11.2 does not apply where prohibited by applicable law (e.g., damages caused by FleetEatsNow's gross negligence or willful misconduct).

11.4 Truck liability. Claims relating to food safety, food quality, vehicle operation, or other matters within the truck's direct control are claims against the truck operator, not against FleetEatsNow. FleetEatsNow may assist in connecting you with the truck or their insurer but is not a party to such claims.

12. Other Provisions

12.1 Independent trucks. Each truck listed on FleetEatsNow is an independent business with its own permits, insurance, employees, and policies. They are not employees or agents of FleetEatsNow.

12.2 Governing law and venue. These terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising from these terms or your use of the platform will be resolved in the state or federal courts located in Pinellas County, Florida.

12.3 Informal resolution first. Before initiating any legal action, you agree to attempt to resolve the dispute informally by contacting us at booking@fleeteatsnow.com. We will respond within 10 business days and work in good faith to reach a resolution.

12.4 Changes to these terms. We may update these terms from time to time. Material changes will be posted at fleeteatsnow.com/customer-terms with the updated date. Continued use of the platform after a material change constitutes acceptance of the updated terms.

12.5 Severability. If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force.

12.6 Entire agreement. These terms, together with our SMS Policy, our Privacy Policy, and any specific terms you accept at booking, constitute the entire agreement between you and FleetEatsNow regarding your use of the platform.
